2. Definitions

In these general terms and conditions the following terms shall have the following meanings:

  • BuddieGo : the company that offers delivery and personal shopping services by bicycle in Amsterdam, hereinafter also referred to as "service provider".
  • Client: any natural person or legal entity that enters into an agreement with BuddieGo or uses its services.
  • Agreement: any agreement between BuddieGo and the client regarding the provision of a service.
  • Service: carrying out deliveries and personal shopping of goods, groceries, meals, packages or other agreed items within the Amsterdam region.
  • Delivery Person/Shopper: the person who performs the service on behalf of BuddieGo .
  • Working area: Amsterdam and any surrounding areas as agreed in advance.



3. Applicability

3.1 These general terms and conditions apply to all offers, quotations, orders, services and agreements of BuddieGo .

3.2 Deviations from these conditions are only valid if agreed in writing by both parties.

3.3 General terms and conditions of the client are expressly rejected.



4. Services

4.1 BuddieGo provides delivery services at the request of the client and based on availability.

4.2 The services are performed exclusively by bicycle, unless expressly agreed otherwise.

4.3 BuddieGo delivers customized services: the content, location, date and time of delivery are tailored to the wishes of the client, to the extent reasonable and feasible.

4.4 BuddieGo reserves the right to refuse an order if it:

  • is considered unsafe;
  • falls outside the working area;
  • does not fit within the ethical or logistical boundaries of the company;
  • does not contain sufficient information for proper implementation.



5. Rates and payment

5.1 All rates are agreed in advance.

5.2 Prices include VAT, unless stated otherwise.

5.3 Payment must be made according to the agreed method and at the agreed time: Payment options include cash, debit card or a digital payment request.

5.4 For business customers, an invoice can be drawn up with a payment term of 7 days, unless otherwise agreed.

5.5 If payment is not made within the agreed term, BuddieGo is entitled to charge administration costs and statutory interest.



6. Cancellation and changes

6.1 Cancellation of an order is possible up to 24 hours before the agreed time of execution. This must be done by telephone or in writing.

6.2 In case of cancellation less than 24 hours before the agreed time of execution, BuddieGo+ reserves the right to charge 50% of the delivery rate.

6.3 Changes in time, location or nature of the service can only be implemented if this is communicated in a timely manner and is feasible.



7. Liability

7.1 BuddieGo is not liable for damage resulting from:

  • incorrectly or insufficiently packaged goods;
  • incorrect or incomplete information provided by the client;
  • force majeure situations such as weather conditions, malfunctions or accidents.

7.2 BuddieGo is only liable for direct damage resulting from intent or gross negligence on its part.

7.3 Damage or loss must be reported in writing within 24 hours of delivery, including supporting documents such as photographs.



8. Client obligations

8.1 The client is responsible for:

  • correct and complete information about the assignment;
  • ensuring safe, properly packaged and legally permitted goods;
  • checking the delivery upon receipt.



9. Force Majeure

9.1 BuddieGo is not bound to its obligations in case of force majeure. Force majeure includes: illness of personnel, weather conditions, government measures, disruptions in means of transport, strikes, etc.

9.2 In the event of force majeure, the service may be postponed, modified or cancelled without liability.



10. Complaints

10.1 Complaints about the performance of the service must be reported in writing within 48 hours of delivery.

10.2 BuddieGo will respond to complaints within 3 working days.

10.3 Submitting a complaint does not release the client from the payment obligation.



11. Privacy and data protection

11.1 BuddieGo processes personal data solely for the purpose of performing the service and in accordance with the GDPR (General Data Protection Regulation).

11.2 Personal data will not be shared with third parties, unless this is necessary for the performance of the service or on the basis of a legal obligation.

11.3 The client has the right to access, correct, delete and transfer his personal data, as well as the right to object to the processing.

12. Intellectual property

12.1 All rights to the brand name, logo, texts and design of BuddieGo remain the property of BuddieGo .

12.2 No part of these materials may be reproduced, made public or used for commercial purposes without the prior written consent of BuddieGo .



13. Applicable law and disputes

13.1 These general terms and conditions and all agreements between BuddieGo and the client are exclusively governed by Dutch law.

13.2 Disputes are preferably resolved in consultation. If this is not possible, disputes will be submitted to the competent court in Amsterdam.
